Career Savvy Coaching Terms and Conditions

These Terms and Conditions apply to all clients who engage in services provided by me, Heather E. Coleman, under Career Savvy Coaching. They're designed to ensure mutual clarity, support, and a strong foundation for our work together.

1. Payment

Payment is due upon receipt of the invoice. All sales are final, and I do not offer refunds once payment is made. By purchasing a coaching package, you reserve a spot in my calendar through the package's expiration date and accept these terms. The rate listed on your invoice is valid for 30 days from the invoice date. To hold your spot, prompt payment is required. If no payment is received within 30 days - and no prior arrangements have been made - the agreement will be null and void. Third-party financing options (such as Affirm, Klarna, or PayPal Credit) are available at checkout for clients who prefer flexible payment.

2. Nature of Services

I provide coaching across career development, leadership, job search strategy, confidence-building, and recovery from toxic or high-conflict work or personal situations. While trauma-informed, this work is not a substitute for therapy or medical care.

3. Results Disclaimer

Coaching provides guidance, tools, and support - not guaranteed outcomes. Results depend on your effort, follow-through, and factors outside my control. This is an investment in your development, not a promise of specific results.

4. Confidentiality

All information you share with me in sessions is confidential. I'm committed to protecting your privacy and creating a safe, supportive space.

5. Scope of Services & Client Responsibilities

All work takes place in scheduled sessions unless we agree otherwise. Coaching is tailored to your specific goals and may include guidance on career development, job search strategy, leadership, communication, boundaries, confidence-building, and navigating difficult work or personal situations. This is not an exhaustive list - support is shaped around your individual needs.

Clients are responsible for:

•        Participating fully in sessions

•        Completing any homework

•        Implementing practices discussed

•        Reviewing/approving all final drafts

6. Accuracy of Information

The quality and usefulness of my services depend on the accuracy and completeness of the information you provide. This is especially important for Video Audits, where I create deliverables based on your submitted materials. I am not responsible for errors, omissions, or outcomes resulting from incomplete, inaccurate, or outdated information provided by you.

7. Email Communication

You can reach me at heather@careersavvycoaching.com, and I aim to respond within 24 hours during the business week. I do not use text or social media messaging for coaching communication.

8. Coaching Package Expiration

Each coaching package includes a set number of sessions and a specific expiration window. All sessions must be scheduled by the client and completed prior to the expiration date unless you make arrangements with me in writing. Otherwise, unused sessions are forfeited.

9. Non-Transferable Services

Services are non-transferable unless agreed upon in writing and completed within the original package timeframe.

10. Scheduling

You're responsible for booking sessions using this link: calendly.com/heatherecolemanappointments

Availability is first-come, first-served, so booking early is encouraged.

11. Rescheduling & Cancellations

You may reschedule or cancel up to 3 sessions with at least 5 minutes' notice. After 3 changes, additional reschedules count as completed sessions. No-shows are also considered complete.

If something unexpected comes up, please let me know. Depending on the circumstances, we may be able to adjust your plan.

12. Virtual Sessions

All sessions are virtual. You'll need a stable internet connection and a device that supports video calls.

13. Video Audits

Video Audit products are delivered via personalized Loom video within 5 business days of receiving your completed intake form, unless delayed due to illness or emergency.

Ask Heather and Resume Audit include video feedback only. Audit Plus includes video feedback plus sample resume and cover letter drafts based on your submitted materials and target job description. These sample drafts are not intended for use as-is. Your revisions are necessary before use, and you are responsible for your own outcomes.

Video Audits do not include revisions. If you would like additional support refining your documents or discussing your results, that work falls under coaching services. All Video Audit sales are final. No refunds.

14. Digital Downloads

Digital products (including toolkits, guides, and worksheets) are delivered electronically upon purchase. Due to the nature of digital products, all sales are final. No refunds.

15. Session Recording

Sessions are not recorded by default. If you request a recording, I'm happy to provide one for your personal use. All session recordings are confidential and remain between us.

16. Testimonials & Case Studies

If you share a testimonial publicly (on Google Business, LinkedIn, social media, or in online groups) or send one to me directly with your permission, I may use it in my marketing materials. Testimonials are shared using first name and last initial only.

I may also share anonymized client stories (with no identifying details such as name, company, industry, or location) for educational purposes in blog posts, videos, or social media content. If you prefer your story not be shared in any form, please let me know in writing.

17. Intellectual Property

All materials provided through Career Savvy Coaching - including toolkits, worksheets, frameworks, guides, templates, video content, and session recordings - are my intellectual property. You may use them for your own personal and professional development, but you may not share, distribute, resell, or reproduce them in any form without written permission.

18. Third-Party Tools & Technology

I use third-party platforms to deliver services, including Zoom, Calendly, Loom, and Thinkific. I am not responsible for outages, technical issues, or service interruptions caused by these platforms or by internet connectivity issues. If a session is disrupted due to technical difficulties, we will reschedule at no additional cost.

19. Payment Disputes & Chargebacks

If you have a concern about a charge or service, please contact me directly at heather@careersavvycoaching.com before disputing with your bank or credit card company. Filing a chargeback without first attempting to resolve the issue with me is considered a breach of this agreement and will result in immediate termination of services, forfeiture of any remaining sessions, and potential collection action for the disputed amount.

20. Age Requirement

All clients must be 18 years of age or older to purchase services from Career Savvy Coaching.

21. Limitation of Liability

To the fullest extent permitted by law, Career Savvy Coaching and Heather E. Coleman shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of services, including but not limited to lost profits, lost opportunities, or career outcomes.

In no event shall total liability exceed the amount you paid for the specific service in question. By purchasing services, you acknowledge that you are reserving time and resources that cannot be recovered, and that refunds are not available regardless of outcome or satisfaction.

22. Indemnification

You agree to indemnify, defend, and hold harmless Heather E. Coleman and Career Savvy Coaching from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of my services, your violation of these Terms, or any actions you take based on coaching guidance. Coaching provides information and support for your consideration - all decisions and actions remain your responsibility.

23. Force Majeure

I shall not be liable for any failure or delay in performing my obligations due to circumstances beyond my reasonable control, including but not limited to: illness, injury, pandemic, natural disaster, government action, internet or power outages, or other unforeseen events. In such cases, I will communicate with you as soon as possible and we will work together to reschedule or adjust services as needed.

24. Price Changes and Lock-In

Once you purchase a package, that rate is locked in for the duration of that package. If you choose to purchase additional packages later, those will reflect the pricing available at that time.

25. Updates to Terms

These Terms and Conditions may be updated from time to time. By purchasing a package or continuing to use services after updates are posted, you agree to the most current version of these Terms. I encourage you to review this page periodically.

26. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

27. Agreement and Governing Law

By submitting payment, you confirm that you've read and accepted these Terms. These terms represent the full understanding between us. Any additional agreements will be documented in writing.

This agreement is governed by the laws of the State of Michigan. In the event of any disagreement or concern, both parties agree to first attempt resolution through direct, good-faith communication. If unresolved, matters may be addressed through mediation before pursuing any formal action. Any formal disputes shall be handled in small claims court in Oakland County, Michigan.

Both parties agree that legal action is a last resort, and that open communication is the preferred path to resolution.

Collaboration & Flexibility

My coaching approach is collaborative and responsive to your needs. Life happens - you're always welcome to share what may impact your progress. If something comes up, we'll discuss adjustments that help accommodate your needs within the coaching structure.
